Terms of Service

1. Service Description

Mallow is an electronic medical record (EMR) platform designed for behavioral health providers in Maryland. Our platform includes clinical documentation, scheduling, billing, compliance, and practice management tools.

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must immediately notify us of any unauthorized access. You agree to provide accurate and complete information during registration.

3. Acceptable Use

You agree to use Mallow only for lawful purposes and in accordance with applicable healthcare regulations, including HIPAA. You may not use the platform to store or transmit malicious code, or to violate any applicable laws or regulations.

4. Payment Terms

Fees are billed according to your subscription agreement. All fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days' written notice. Late payments may result in service suspension.

5. Data Ownership

You retain full ownership of all data you input into the platform, including patient records and clinical documentation. We do not claim ownership of your data. Upon termination, we will provide data export assistance and securely delete your data upon request.

6. Limitation of Liability

7. Termination

Either party may terminate this agreement with 30 days' written notice. We may suspend or terminate your account immediately for violations of these terms. Upon termination, your right to access the platform ceases, and we will assist with data export.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Maryland.
